General Terms and Conditions of Sale – Atelier Sélénia

These General Terms and Conditions of Sale (hereinafter referred to as the "GTC") govern the sales of indoor and outdoor furniture made on the website www.atelierselenia.com (hereinafter referred to as "the Site"), operated by Atelier Sélénia , a Swiss sole proprietorship, based in Sion (Switzerland) and carrying out commercial activity primarily for customers located in France.

By placing an order on the Site, the Customer accepts these Terms and Conditions without reservation.

2. Products offered

Atelier Sélénia offers furniture for the home and garden, as well as decorative items. Some products are in stock, others are made to order.

The photographs and descriptions are as accurate as possible, but variations in color, texture or finish may exist depending on the materials used (wood, stone, metal…).

3. Price

Prices are expressed in euros (€), inclusive of all taxes (VAT) , excluding delivery charges. The total price including VAT and the applicable delivery charges are shown before order confirmation.

Atelier Sélénia reserves the right to change its prices at any time. However, products will be billed according to the rates in effect at the time of the order.

4. Orders

Orders are placed online on the Site. Any confirmed order implies an obligation to pay.

The Seller reserves the right to cancel any order in the event of non-payment, an invalid delivery address, or a prior unresolved dispute.

5. Payment

Payment is made online via secure methods: credit card, PayPal, or any other method indicated during the order.

The order is only considered final after the full amount has been received.

6. Delivery

6.1. Delivery Area

Delivery is provided in mainland France and other European Union countries, from a warehouse located in the European Union.

6.2. Deadlines

Delivery times vary between 5 and 30 working days , depending on the product (in stock or made to order) and the delivery address.
In case of delay, Atelier Sélénia undertakes to keep the Client informed.

6.3. Conditions

Bulky furniture is delivered to the doorstep (in front of the house or at the foot of the building). The customer may be asked to arrange assembly or transport upstairs.

In the event of an incomplete address, absence at the time of delivery, or unforeseen access conditions, the costs of a second delivery will be borne by the Customer.

7. Acceptance and reservations

The Customer is required to check the condition of the products upon receipt. In the event of missing or damaged products:

• Make specific reservations on the delivery note .

• Send a written complaint with photos to info@atelierselenia.com within 72 hours .

If no notification is received within this timeframe, the product is deemed to be compliant.

8. Right of withdrawal (France)

In accordance with Articles L221-18 et seq. of the Consumer Code , the Customer has a period of 14 days from receipt of the order to exercise their right of withdrawal, without justification.

To exercise this right:

• The product must be new, unassembled, unused , and returned in its original packaging .

• The Client sends their request to info@atelierselenia.com .

Return shipping costs are the responsibility of the customer. Refunds are processed within 14 days of receiving and verifying the returned product.

9. Exceptions to the right of withdrawal

In accordance with the law, the right of withdrawal does not apply to:

• Products made to order or customized

• Products that have been assembled, damaged, or used

• Products unpacked and not repackaged

10. Legal Guarantees

The products sold benefit from the legal guarantees of conformity (articles L217-4 to L217-14 of the Consumer Code) and of hidden defects (articles 1641 to 1649 of the Civil Code).

In case of a defect, the Customer must inform the Seller at info@atelierselenia.com , providing supporting photos. If the claim is justified, the product will be repaired, replaced, or refunded.

11. Responsibility

Atelier Sélénia cannot be held responsible for damages resulting from:

• Due to improper installation or use of the product

• Due to force majeure

• Due to a delayed delivery attributable to the carrier

12. Personal Data

The personal data collected via the Site is used solely within the framework of the business relationship. It is processed in accordance with the GDPR (European regulation) and is never resold.

13. Intellectual Property

All content on this Site (texts, photos, logos, products, etc.) is the exclusive property of Atelier Sélénia. Any reproduction or use without authorization is prohibited.

14. Applicable Law and Disputes

These General Terms and Conditions are subject to French law , for any sale concluded with a Customer located in France.

In the event of a dispute, the Customer is invited to contact customer service to attempt an amicable resolution.
Failing that, the dispute may be brought before the competent court in the Client's place of residence .
